Wecome to the KanbanWork service, website and/or mobile application (collectively, the "Site" or "KanbanWork"). Your use of this Site is subject to the Terms of Use and Privacy Policy (collectively, the "Terms"). These Terms are a legal agreement that you agree to be bound by when you access and/or use the Site. If you do not agree with the Terms of this agreement, do not use the Site.

KanbanWork reserves the right to update and change the Terms at any time without notice or acceptance by you. The entire Site is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. Any updates to the Site shall be subject to these Terms.

Words using or implying singular in number also includes the plural and vice versa. References to any specific gender also includes the other gender.

Fees begin on the date that exceeds your limit of free usage and you input credit or debit card details. Your provided credit or debit card will be billed on that date and monthly thereafter. All payments are based on the number of additional users you provide access to your Kanban boards. The per user fee is subject to change without notice. If you choose to cancel your account then access to your Kanban boards will cease for all users. No refunds are provided or available. If your payment method fails then access to Kanban boards will cease for all users.

You agree not to access the Site by any means other than through the interfaces that are provided by KanbanWork.

In order to use the Site, you may require a valid Account. To acquire an Account, you must provide KanbanWork with an electronic mail address. You are responsible for maintaining the confidentiality of the access data for your Account, and are fully responsible for all activities that may occur under your Account. KanbanWork has the right to suspend or terminate your Account at any time for any reason.

By using this Site, you represent and warrant that you are at least 13 years of age. KanbanWork is not directed towards children.

KanbanWork retains ownership of all proprietary rights in the Site and in all trade names, trademarks and service marks associated or displayed within the Site. You may not reverse engineer any software associated with this Site.

KanbanWork does not claim ownership of any User Content submitted on this Site except that which is posted through the Feedback feature. You are solely responsible for any content you upload, post, transmit or share on this Site. KanbanWork does not guarantee the accuracy, integrity or quality of any content posted or service provided on the Site.

You agree that KanbanWork has no responsibility or liability for the deletion of, or the failure to store or transmit any content on the Site. KanbanWork retains the right to create limits on use and storage at our sole discretion at any time with or without notice.

You agree that the Site is provided "as is" and on an "as available" basis. KanbanWork disclaims all warranties of any kind, expressed or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, non-infringement or bailment of your data on KanbanWork. The Site makes no warranty or representation regarding the results that may be obtained from the use of KanbanWork. You are solely responsible for any damage to you resulting from the use of this Site.

You agree to indemnify, defend and hold harmless KanbanWork, its affiliates, officers, directors, employees, consultants, agents, suppliers and Resellers from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorneys fees as and when incurred) arising from your use of the Site, your use of your Account, your violation of these Terms or the infringement or violation by you or any other user of your Account, of any intellectual property relating to the Site (including without limitation your user content) or other right of any person or entity.

KanbanWork does not provide any guarantee that this Site shall be error-free, free of defects, or without interruption or non-availability and reserves the right at any time to modify or discontinue, temporarily or permanently, the Site (or any part thereof) with or without notice. You agree that KanbanWork shall not be liable to you or to any third party for any modification, suspension, termination or discontinuance of the Site.

No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship between you and KanbanWork is intended or created by these Terms.

KanbanWork's liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising out of our breach of these Terms shall be limited to the value of your monthly subscription at the relevant time.

This agreement shall be governed by and construed under the laws of the State of Arizona, USA, as applied to agreements entered into and to be performed in Arizona by Arizona residents. The parties consent to the exclusive jurisdiction and venue of the courts located in and serving Phoenix in the State of Arizona, USA.

You may not assign or transfer these Terms to any third party without the prior written consent of KanbanWork.

If any of these Terms are found unlawful, invalid or unenforceable then that does not affect the validity and enforceability of the remaining Terms.

The Terms, as set on KanbanWork.com, supersede all prior oral or written agreements regarding KanbanWork.
